2. Definitions & Interpretations
Within this agreement, the following terms are defined as:
- "Misfuelling" or "Wrong Fuel": The accidental or intentional introduction into a vehicle's mechanical system (including but not limited to motorbikes, passenger cars, light commercial vans, lorries, and HGVs) of any fuel, liquid, or chemical substance that is not explicitly specified for use in that vehicle by the manufacturer. This includes putting petrol into a diesel tank, diesel into a petrol tank, or introducing AdBlue, water, oil, screenwash, or contaminated biofuels into any part of the vehicle’s fuel, exhaust, or cooling network.
- "The Service": The technical evacuation, extraction, and clean flushing of the contaminated fuel system, followed by the safe transport and certified environmental disposal of the hazardous chemical waste.
3. Scope of Service: What is Included & Excluded
Included within the standard call-out rate:
- The professional removal and technical evacuation of the contaminated fuel mixture from the customer’s vehicle using designated fuel drainage equipment.
- The legal transport, handling, and certified environmental disposal fees for the contaminated fuel mixtures in accordance with UK Environmental Agency guidelines.
Excluded from the standard call-out rate:
- The physical cost of any fresh, clean fuel (petrol or diesel) required to prime, restock, or restart the vehicle's engine following a system flush.
- The cost of mechanical replacement parts, such as primary or inline fuel filters.
- The cost of specialized fuel system cleaners, lubricity additives, or chemical system flushes.
- Note: All fresh fuel, parts, and additives supplied by our technicians on-site will be billed separately and added to the final payable balance.
4. Limitation of Liability & Mechanical Damage Exclusions
Modern automotive fuel systems utilize highly sensitive electronic components, common-rail injectors, and high-pressure fuel pumps that have incredibly low tolerances for fluid contamination.
🛑 Critical Mechanical Liability Disclaimer:
Misfuelled Car Fixer Ltd will not be held legally or financially liable for any vehicle damage, component degradation, or mechanical failure that has already occurred, or may occur in the future, as a consecutive result of fuel contamination or driving a misfuelled vehicle.
- Pre-Existing & Future Damage: Running an engine, turning the ignition key to the accessory position, or attempting to drive a vehicle with the wrong fuel can cause severe internal scoring, pressure loss, and systemic wear. You acknowledge that our mobile fuel drain service is a decontamination procedure, not a mechanical repair service.
- No Guarantee of Ultimate Mechanical Function: Our wrong fuel services do not guarantee that the vehicle will be entirely free from subsequent mechanical anomalies, fuel pump failures, or auxiliary system damage resulting from the initial contamination.
- Failed Restarts due to Prior Damage: If mechanical or electrical damage has already occurred to the vehicle's high-pressure injection components due to misfuelling, and the vehicle subsequently fails to start or run smoothly after a clean system flush, the full quoted balance remains completely due and payable to Misfuelled Car Fixer Ltd for the labor, extraction service, and chemical disposal costs incurred.
- Third-Party Independent Contractors: Misfuelled Car Fixer Ltd accepts responsibility solely for the direct actions and procedures executed by a direct, fully contracted employee of Misfuelled Car Fixer Ltd. We accept zero legal, financial, or operational liability for any independent third-party agent, regional subcontractor, recovery driver, or external mechanic acting on our behalf or introduced via our networks.
- Authorisation Warranty: By instructing our team or booking our services, you formally warrant to us that you are fully authorized by the legal owner and registered keeper of the vehicle to commission a technical fuel drain.
5. Fuel Filter & Preventative Recommendations
Following a severe fuel mix-up, elements of chemical contamination can easily remain trapped inside the dense paper fibers of a vehicle’s primary fuel filter.
We strongly advise all customers to have their vehicle's primary fuel filter replaced at the absolute earliest opportunity following our service. Please consult openly with our attending technician regarding any necessary mechanical precautions, driving advice, or specialized diagnostic recommendations specific to your vehicle model.
6. The "No Start, No Fee" Policy Basis
Our widely advertised "No Start, No Fee" guarantee is strictly conditional and is provided exclusively on the baseline assumption that the vehicle's internal fuel system, injectors, fuel lines, electrical sensors, and high-pressure fuel pumps have not already sustained terminal mechanical wear, scoring, or permanent damage as a result of the misfuelling event.
If our technician flawlessly clears out the contaminated fluids, but your engine fails to turn over or function purely due to prior internal mechanical breakdown or electrical issues caused by driving on the wrong fuel, the "No Start, No Fee" policy becomes invalid, and the full drainage fee applies.
7. Booking Procedures, Deposits, & Cancellation Policies
To maintain an efficient emergency dispatch network, Misfuelled Car Fixer Ltd enforces strict booking and mobilization policies:
- Mandatory Upfront Booking Deposit: A secure booking deposit is strictly required from all customers to confirm an emergency service slot and formally authorize the physical routing of a technician van to your coordinates.
- Non-Refundable Cancellation Terms: Customers retain the legal right to cancel our requested service at any time without supplying a reason. However, once an emergency van has been dispatched to your location, the booking deposit is strictly non-refundable and will be retained entirely by Misfuelled Car Fixer Ltd to cover the immediate fuel, staffing, logistical, and operational costs associated with emergency mobilization. By paying the deposit over the phone or via a link, you explicitly accept these terms.
- Rescheduling Provisions: Should you wish to modify or reschedule your service booking time rather than canceling it completely, the non-refundable deposit can be fully applied and transferred forward to the newly agreed rescheduled time slot.
8. Absolute Right of Refusal
Misfuelled Car Fixer Ltd maintains an absolute right to refuse service, cancel a live dispatch route, or immediately cease an ongoing on-site extraction for any of the following reasons:
- The customer, or anyone accompanying the customer, behaves in a threatening, aggressive, abusive, or demeaning manner toward any Misfuelled Car Fixer Ltd employee, mobile technician, phone operator, or third-party subcontractor.
- The customer has deliberately or falsely misrepresented their identity, vehicle registration, location, entitlement to service, or mechanical circumstances.
- The customer flatly refuses to process the required mandatory upfront booking deposit.
9. External Hyperlinks & External Web Content
Our various operational websites may contain directional hyperlinks to third-party web domains, local review portals, or generic automotive advice platforms. Unless explicitly stated otherwise, Misfuelled Car Fixer Ltd exercises zero editorial control, assumes no legal responsibility, and rejects all liability for the content, privacy policies, data tracking, or accuracy of any external third-party web portals.
10. Formal Complaints Procedure
We highly value customer feedback and view it as a primary tool to refine our customer service. If you have experienced an issue or wish to formally file a complaint regarding an emergency fuel drain, we want to hear from you directly:
- By Telephone: 0330 122 6640
- By Email: info@misfuelledcarfixer.co.uk
Subcontractor & Agent Clause:
If your emergency fuel drain was allocated to, and carried out by, an independent third-party agent, localized recovery company, or external network mechanic working on our behalf, you must raise your complaint directly with that specific service provider or company. Because they operate as completely distinct corporate and mechanical entities, Misfuelled Car Fixer Ltd is unable to take administrative action, process refunds, or intervene in legal or structural disputes arising from independent contractor jobs.
